1. Who we are & acceptance of Terms
This website is operated by Excello Books Ltd, a company registered in England and Wales under company number 10487109, trading as "Excello Books" ("Excello Books", "we", "us", "our"). Our registered office and correspondence address is 170 Heys Road, Prestwich, Manchester, England, M25 1QL. You can contact us through our contact page or at info@excellobooks.co.uk. Excello Books Ltd is not currently VAT registered.
By accessing or using the Excello Books website, creating an account, or placing an order, you agree to these Terms & Conditions, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy. If you do not agree, please do not use our website.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or place an order on Excello Books. By using the website, you confirm that you meet this requirement.
3. Accounts
A free account is required to purchase ebooks and access your Library. You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out under your account. Please notify us immediately if you believe your account has been accessed without your authorisation.
4. Products & Orders
We list ebooks, physical books, stationery, toys, and miscellaneous items, and we make reasonable efforts to ensure that product descriptions, pricing, availability, and images are accurate. However, occasional errors may occur. We reserve the right to correct errors, update information, limit quantities, refuse, or cancel orders where reasonably necessary. If a pricing or listing error is discovered after you've placed an order, we'll contact you before proceeding and you're free to cancel with a full refund. If we cancel an order due to such an error, or you cancel it on this basis, we will refund the full amount charged for the cancelled item(s), including any delivery charge paid on those items, to your original payment method.
5. Payments
Online payments (including for ebooks) may be processed by Stripe or another authorised payment service provider shown to you at checkout. Available payment methods, including whether Cash on Delivery is offered for physical items, may vary by product, location, and order type, and will always be shown before you complete your purchase. Ebooks unlock into your Library once payment has cleared. Placing an order is an offer to buy; all orders are subject to payment verification, acceptance, and product availability, and we may decline or cancel any order, including for suspected fraud or stock issues, in which case any payment taken will be refunded in full.
6. Digital Content Licence
Purchasing an ebook grants you a personal, non-exclusive, non-transferable licence to keep and read that file for your own personal, non-commercial use, for as long as your account remains in good standing and subject to this Licence. Files are typically supplied as PDFs. To protect authors, publishers, and legitimate customers, files may include identifying information (such as an order reference or purchaser details) embedded in the file. We may, where reasonably necessary for security, fraud prevention, or to comply with a rights holder's requirements, apply additional protective measures to future deliveries without this reducing your ability to read files you have already lawfully purchased. Ebooks may not be copied, reproduced, shared, distributed, resold, sublicensed, modified, published, or used for commercial purposes without prior written permission from the copyright owner; copyright remains with the respective authors and publishers.
Access to purchased ebooks is personal to you and limited to your own account. Automated, bulk, or credential-shared downloading is prohibited. Where we reasonably suspect fraud, abuse, unauthorised sharing, or a breach of this Licence, we may temporarily restrict or suspend access to affected content while we investigate. If you believe this has happened in error, contact us through the contact page and we will review it promptly. Any restriction of access under this clause does not remove any statutory refund or remedy rights you may have under applicable law.
7. Intellectual Property
Excello Books' name, logo, and website design, along with all text, graphics, and other original content on the site (excluding the licensed books and ebooks sold through it), are owned by or licensed to Excello Books and are protected by applicable intellectual property laws. You may not use, copy, or reproduce these without our prior written permission.
8. Acceptable Use
You agree not to misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious software, or use the website for any unlawful purpose.
9. Account Suspension & Termination
We may suspend or terminate your account, without notice, if we reasonably believe you have breached these Terms, misused the website, or engaged in fraudulent or unlawful activity.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Excello Books shall not be liable for any indirect, incidental, consequential, special, or economic losses (including loss of profits, data, or goodwill) arising from the use of our website, products, or services, even if we have been advised of the possibility of such losses. Subject to the paragraph below, our total liability to you in connection with any single order shall not exceed the total amount you paid for that order.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law, nor does anything in these Terms exclude or limit any statutory rights or remedies available to you as a consumer under the laws of Pakistan, the United Kingdom, the United Arab Emirates, or any other jurisdiction where such rights are mandatory.
11. Governing Law & Disputes
These Terms & Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction to settle any such dispute or claim, meaning you may also be entitled to bring proceedings in the courts of the country you live in. Nothing in this clause limits any mandatory consumer protection rights available to you under the laws of your country of residence, where such rights apply and cannot legally be excluded or restricted by agreement.
12. Changes to These Terms
We may update these Terms & Conditions at any time. The latest version will always be published on this website with the revised "Last Updated" date. Continued use of the website after any changes become effective constitutes acceptance of the updated Terms for future use and orders. Any order you have already placed remains governed by the version of these Terms in effect at the time that order was placed, except where a change is required to comply with applicable law.
